Warehouse Program

Curve

The liability of a Warehouse Operator or a logistics company offering warehouse services will vary based on several factors.  Under the law, a warehouse operator is simply required to demonstrate that they used reasonable care to protect properly in their care, custody, and control. If is a fairly lenient standard but failing to do so could result in the operator being held liable for physical loss or damage to cargo.

However, when a Warehouse Operator issues a warehouse receipt or uses a storage contract with their clients, these documents may limit or expand the losses that they become liable for. These documents might limit a warehouse operator's liability to an amount based on the weight of the goods or they may expand the warehouse operator's liability to include all loss or damage to cargo (regardless of negligence) and up to the full value.
