CBP Announces Staggered Approach to ACE Initiative


On February 29, 2016, CBP published Federal Register Notice (FRN) 81 FR 10264 announcing that CBP will begin decommissioning ACS to accommodate ACE as the sole system for processing certain entry types by the March 31, 2016 deadline. The notice also announced the conclusion of two PGA pilots effective February, 29, 2016, including Animal and Plant Health Inspection Services (APHIS)/Lacey Act and National Highway Traffic Safety Administration (NHTSA). Effective March 31, 2016, the deadline for ACE Entry Summary applies to the following entry types:

  • 01 – Consumption (Free and Dutiable)
  • 03 – Consumption (AD/CVD)
  • 11 – Informal (Free and Dutiable)
  • 23 – Temporary Importation Bond (TIB)
  • 51 – Defense Contract Administration (DCASR)
  • 52 – Government-Dutiable

Effective March 31, 2016, the deadline for ACE Cargo Release and ACE Entry Summary also applies:

    • To the above referenced entry types (01, 03, 11, 23, 51 and 52) if they also include APHIS Lacey Act and/or NHTSA data, unless other PGAs other than APHIS Lacey or NHTSA are involved.
    • For example, if an 01 entry type involves NHTSA and another PGA, such as the Environmental Protection Agency (EPA), the March 31st deadline does not apply.
        • The deadline for the remaining PGAs will be announced at a separate time upon conclusion of existing PGA pilots.
            • CBP encourages all filers and importers to participate in PGA pilots now to be prepared for deadlines to be announced this summer. For additional information, please refer to CBP’s website at http://www.cbp.gov/trade/ace/features#field-content-tab-group-tab-5.

              Effective May 28, 2016, the deadline for ACE Cargo Release and ACE Entry Summary applies to the following entry types:

              • 01 – Consumption (Free and Dutiable)
              • 03 – Consumption (AD/CVD)
              • 06 – Foreign Trade Zones
              • 11 – Informal (Free and Dutiable)
              • 23 – Temporary Importation Bond (TIB)
              • 51 – Defense Contract Administration (DCASR)
              • 52 – Government-Dutiable

              With the March 31st deadline quickly approaching, it is important to note that you must also file an eBond for any single transaction bond you process as an ACE Cargo Release transaction.               According to ACE Adoption Reports posted on CBP.gov, over 32% of all entries are filed in ACE as Cargo Release transactions and close to 80% of all Entry Summaries are filed in ACE.
