Court grants 90-day stay of HOS rules
Implementation of the U.S. Federal Court of Appeals decision to strike down provisions to the Hours of Service (HOS) has been delayed until no later than Dec. 27.
The court granted the request of the American Trucking Associations asking for a stay on the HOS provisions.
The 11-hour limit and 34-hour restart
were the two provisions rejected because
of a lack of evidentiary support. Most likely, the Federal Motor Carrier Safety Administration will try to provide sufficient evidence to maintain current provisions.
While current HOS rules remain, the trucking industry may want to prepare for changes.
