FMCSA proposed regulations for intermodal equipment providers

On December 21, 2006, the Federal Motor Carrier Safety Administration (FMCSA) published a notice of proposed rulemaking, which would require intermodal equipment providers (IEP) to follow the Federal Motor Carrier Safety Regulations (FMCSRs). The proposed regulation would fulfill section 4118 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA –LU), which requires regulations to be added to the FMCSRs for intermodal equipment to improve safety and maintenance.

The proposed rule would require IEPs to:

  • Register with the FMCSA and file an Intermodal Equipment Provider Identification Report (Form MCS – 150C).
  • Display the USDOT number or other unique indentifier on each intermodal container chassis used in interstate commerce.
  • Implement and save records of a systematic inspection, repair and maintenance program.
  • Respond promptly to mechanical defects reported by drivers and motor carriers.

Under this proposed ruling, the FMCSA plans to assess regulatory compliance status and the safety of IEPs onsite by reviewing the records of the IEP’s inspection, repair and maintenance program. IEPs outside of the U.S. are not subject to this proposed ruling.
