Court rejects portion of HOS rules

The U.S. Court of Appeals for the Washington, D.C. Circuit struck down a portion of the Hours of Service (HOS) rules applying to truckers on July 24.

Litigation regarding the 2005 HOS rules was initiated when Public Citizen and the Owner-Operator Independent Drivers Association (OOIDA) filed suit against the Federal Motor Carrier Safety Administration (FMCSA).

Public Citizen challenged the 11-hour limit and 34-hour restart provisions, allowing truckers to drive more hours than previous HOS rules. The court found that the FMCSA did not provide evidence supporting these provisions.

OOIDA petitioned to reinstate the previous split-sleeper berth rules which provided more flexibility in obtaining ten consecutive hours off-duty. The OOIDA petition was denied since the FMCSA proved the 8-hour requirement would reduce fatigue-related accidents.

The FMCSA has 45 days to petition for reconsideration. The court’s decision will not go into effect before September 14. The American Trucking Associations (ATA), a supporter of the current HOS, is requesting a stay from the court. If granted, current HOS rules would remain in place until the FMCSA provides explanations of the two provisions.
